The Battle for Whiteness: United States v. Bhagat Singh Thind and How Courts Upheld White Dominance

Sergent Bhagat Singh Thind in US army
Bhagat Singh Thind: The soldier who fought for US in
First World war After his petition was granted, government attorneys
initiated a proceeding to cancel Thind's naturalization and a trial
followed in which the government presented evidence of Thind's political
activities as a founding member of the Ghadar Party, an Indian independence movement headquartered in San Francisco. He attempted to be classified as a "free white person" within the meaning of the Naturalization Act based on the fact that Indians and Europeans share common descent from Proto-Indo-Europeans. The Court unanimously rejected Thind's argument, adding that Thind did not meet a "common sense" definition of white, ruling that Thind could not become a naturalized citizen.

On
February 19th, 1923, Bhagat Singh Thind was denied American citizenship
by the Supreme Court. Almost two decades later, he struggled for his
freedom in a prison cell. Thind fought case for 20 years, lost twice
in lower courts and once in Supreme court and Ultimately won the case
in Supreme court for citizenship for all non-whites.
My Research about Background of the Great Fighter, achiever and History maker! The news
of Celebrations of 100th anniversary on July 4 ,2013 of Dr. Bhagat
Singh Thind's landing in USA aroused Curiosity to know background of
great man.The Thind Sur name in India is popular in Two cities of
Punjab, Amritsar and Ludhiana. Ludhiana Thinds consider themselves as
Jat Sikhs and Amritsar's Thinds are Kamboj- Sikhs, Hindus, Muslims and
Buddhists. Bhagat Singh being turbaned Sikh, I presumed that he may have
Amritsar connection. After reorganisation of state of Punjab in 1966 I
was transferred from Kulu to Amritsar in Nov.1966 and remained posted as
SDO PWD, building and roads for 3 years, as such was familiar about
every nook and corner of Amritsar. After his high school graduation in
1908, Dr. Thind enrolled at Khalsa College in Amritsar and obtained his
college degree. This led me to believe that Dr. Thind might be from
Kamboj clan. Having learned that Bhagat Sing was born in 1892 in a
well-known military family of village Taragarh/Talawan,(I used to share
my research work with my wife). She told me that her mother Swaran Kaur
Josun's maiden name was Swaran Kaur Thind and that she was also born in
village Taragarh in Talwan Sub-Tehsil and village Taragarh and that this
village is inhabited largely by Kamboj community. I had got constructed
Taragarh -Talwan link road constructed in 1968 and had learned about
Bhagat Singh's ancestors. His father, S. Boota Singh Thind, was retired
as Subedar Major from the British Indian Army. His mother, Isher Kaur,
died when Dr. Thind was only a young child.
Dr.
Thind’s ancestors had earlier served in the Sikh army of Maharaja
Ranjit and even before that, in the Marjeewra(A man not afraid of death)
Sikh fauj(Army) of 10th Lord,Guru Gobind Singh. This earned a good name
as a Warriors’ family. S. Boota Singh Thind, his family, and all his
relatives were very dedicated Sikhs and had actively participated in
Sikh Morcha for possessions of lands belonging to Gurudwara Pheru, at
Lahore in 1924 and earlier in Nankana Sahib Morcha of 1921 (In which out
of 86 Singh Shaheeds, 32 were the Kamboj Singhs). S. Boota Singh Thind
was jailed for several years and lost his military pension as a
consequence. He had also persuaded numerous other Kamboj Singhs of
Shekhupuru to actively participate in the movement. Thus, it is clear
that Dr. Bhagat Singh Thind had inherited the love for Sikhism and
humanity from his devoted Sikh parents and relatives as mentioned above.
